Terms of Service

1. Acceptance of Terms

By accessing or using Elevate("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Elevate provides a platform for personal trainers to manage clients, create training plans, and track progress. The Service includes tools for plan generation, client management, and communication.

3. User Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account.

4. Trainer Responsibilities

Trainers are responsible for the accuracy of training plans created using the Service. While the Service provides tools to assist with plan creation, trainers must review all plans before sharing them with clients. The Service does not replace professional judgment or certifications.

5. Client Data

Trainers are responsible for obtaining appropriate consent from clients before entering their personal information into the Service. Client data is stored securely and is only accessible to the trainer who created the client profile and the client themselves.

6. Acceptable Use

You agree not to use the Service to: (a) violate any applicable laws or regulations; (b) transmit harmful or malicious content; (c) impersonate another person or entity; (d) interfere with the proper functioning of the Service; or (e) provide medical advice or diagnoses.

7. Intellectual Property

Training plans and content you create using the Service remain your intellectual property. You grant Elevate a limited license to store and display your content as necessary to provide the Service.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. Elevate does not guarantee the accuracy of generated training plans and is not responsible for injuries or health issues that may result from following any training program created using the Service.

9. Limitation of Liability

To the maximum extent permitted by law, Elevate shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated terms.
